Why Prodhan continue JS membership: HC

The High Court on December 1 issued a rule upon the Government and the Election Commission to explain that Joypurhat-1 constituency MP, Mojahar Ali Prodhan, is holding his office under which jurisdiction.

The rule is returnable within three weeks.

The Speaker of the Parliament, the Chief Election Commissioner, the Secretaries to Law Ministry and EC Secretariat and Mojahar Ali Prodhan have been made respondents in the rule.

A bench of the High Court comprising Justice AHM Shamsuddin Chowdhury Manik and Justice Sheikh Md Zakir Hossain issued the rule following a public interest Writ petition.

A voter of the constituency, ASM Kawsar uz Zaman, filed the writ petition with the HC on Monday challenging legality of holding the office of Jatiya Sangsad membership by Prodhan.

The petitioner in his petition, alleged against Prodhan of providing false information regarding his property to the Election Commission.

Advocate Manzill Murshid appeared for Prodhan in the court while Deputy Attorney General ABM Altaf Hossain stood for the government.

Advocate Manzill told the court that JS membership of Prodhan is eligible to be cancelled for providing false information, as per rules of RPO.
