Constable files GD against HC judge

In an unprecedented action, Shahbag police recorded a general diary (GD) against a High Court judge.

A police constable, Md Harun-or-Rashid (No 5662), filed the GD (No 1445) against Justice AHM Shamsuddin Chowdhury for abusing him (constable) in public while performing traffic duty in front of Supreme Court on Thursday morning. 

Corporal punishment: Yes or no?

Why withdrawal of an attempt-to-rape case against AL leader should not be illegal: HC

The High Court on Tuesday issued a rule upon the government to explain why withdrawal of an attempt-to-rape case, filed against ruling Awami League lawmaker Kamal Ahmed Mazumder and others, should not be cancelled.

The rule is returnable within four weeks.
 Both pro- and anti-government lawyers of the Supreme Court have declared programmes and counter programmes over the chief justice's court.
The pro-opposition lawyers announced on Wednesday that they would boycott the chief justice's court on Thursday from 9am to 10am.

JUDICIARY GRAFT: Probe harassment allegations: CJ

The chief justice has asked the committee, formed to investigate corruption in the judiciary, to look into allegations why petitioners were harassed after getting bails.

A B M Khairul Haque sent a letter in this regard to the committee chairman, Surendra Kumar Sinha, on Wednesday, three days after it was formed.

SCBA faction to boycott court of CJ

The pro-BNP group of Supreme Court Bar Association (SCBA) will boycott the Chief Justice's court today (January 27) from 9 am to 10 am protesting his reported interference in cause lists and court's files and his remarks on lawyers.

The lawyers will stage a sit-in programme during the one-hour boycott in front of the CJ’s courtroom.

HC orders Maj gen shishu's production to court

The High Court yesterday (January 26) directed the government to explain why formation of the military Tribunal that in 1976 had tried Hasanul Haq Inu, Rabiul Alam and others would not be declared illegal and unconstitutional.

The government was also asked to answer why the sentence given by the Tribunal against them would not be declared illegal. 

HC ask to enact victim, witness protection act

The High Court yesterday (January 26) ruled that the term 'sexual harassment' would be used instead of 'eve teasing' from now saying that importance of the crimes lessens at the term eve teasing.

Declaring 'stalking' against girls and women illegal, the HC asked the government to define its meaning in view of the current context, said concerned lawyer.

Corporal punishment and kids' development

While our education sector is undergoing some visible changes in both affirmative and negative terms, like commencement of new education policy implementation, distribution of free textbooks to school going children at the beginning of the new year, along with outburst of sexual harassment of girls studying in schools and colleges, a historical order passed by the High Court banning corporal punishment of' students in educational institutions. 
 
The High Court judgment simultaneously declared corporal punishment unconstitutional and violation of human rights, while disposing writ petition filed by Ain-o-Salish Kendra and Bangladesh Legal Aid and Services Trust. This verdict of the High Court is expected to expedite change in the traditional approach to children in regard to their education and mode of teaching. The government has been asked to constitute an independent national commission to ensure an end to the bad practice as well.

HC summons 5 over construction near Mahasthangarh

The High Court on Sunday summoned two Bogra local leaders of the ruling Awami League and three others on charges of constructing a road near Mahasthangarh historical place despite a HC order.


A bench of Justice AHM Shamsuddin Chowdhury Manik and Justice Sheikh Md Zakir Hossain directed them to appear before the court on January 30 for their statements in connection with the construction.

Local AL leaders are Khokon Sarkar and Sabuj Sarkar, officer-in-charge of Shibganj Police Station, curator and president of Mahasthangarh Mazar Unnayan Committee.

HC stayed construction at Amoligola ground

The High Court has stayed for three months construction on Lalbagh's Amoligola ground, once used as a children's park.

The bench of justices A H M Shamsuddin Chowdhury and Sheikh Mohammad Zakir Hossain issued the order in response to a petition filed by a local, Reaz Uddin, on Sunday.

AL lawyers protest CJ role

The pro-Awami League lawyers yesterday (January 23) expressed angry over the role of Chief Justice ABM Khairul Haque for introducing new High Court Division management system in disposing of cases.

At a meeting of Awami Ainjibi Samannay Parishad at the auditorium of Bangladesh Bar Council, the lawyers criticised  the role of the CJ in introducing sector-wise Writ bench of the HC Division and selecting particular petitions at his residence and putting those in the cause list for hearing.

BJSA for punishment of TIB officials

A lawyer's organisation has demanded exemplary punishment of the officials of Transparency International, Bangladesh for their unreliable and false report on corruption in judiciary.
A statement by Bangladesh Judicial Service Association on Sunday said the TIB report had tarnished the image of the country's apex court judges.

5-judge body to probe graft in judiciary

Chief Justice ABM Khairul Haque on Sunday set up a five-judge probe committee to find out corrupt people in the judiciary, aiming to remove harassment of people.


Justice SK Sinha, a judge of the Appellate Division of the Supreme Court, will lead the team.

The other four judges are from the High Court Division of the apex court. They included Justice Md Anwarul Haque, Justice AKM Fazlur Rahman, Justice Mayeenul Islam Chowdhury and Justice Hasan Faiz Siddiqui.

HC directive ignored: 587 Bangladeshis in Indian jails after serving sentence

A total of 587 Bangladeshi citizens are languishing in Indian jails even after ending their jail terms. They are yet to be brought back to the country, ignoring the High Court order that directed the government to do so.
Informed sources say, around 2,5000 Bangladeshi citizens are detained in Indian jails on different charges. Of them, about 587 completed their jail terms, according to sources. Following a public interest litigation, a bench of the High Court Division on November 1 directed the government to take effective measures to bring back the 587 Bangladesh citizens from Indian jails and to inform the court within 30 days what steps it has taken to bring them back.

SC lawyers protest sectorwise benches

The new High Court Division management system introduced by Chief Justice ABM Khairul Haque in disposing of the cases has led to severe unrest, agitation and anxiety among the lawyers belonging to both pro-government and pro-opposition groups.

The reconstituted HC Division with specific sector-wise jurisdiction has made the judicial procedures more complicated, impeding quick disposal of cases, further increasing the backlog and hampering the dispensation of justice at the apex court, said the SC lawyers.

While speaking as chief guest at a book launching ceremony at the Institute of Judicial Administration and Training in the capital on January 15, Chief Justice A.B.M. Khairul Haque said that a five-member committee comprised of senior judges of the High Court had been formed to identify corrupt people in the judiciary on the basis of the graft report of Transparency International Bangladesh (TIB).

Zia executed Taher 'under pressure' : Moudud tells HC; court seeks US journo Lifschultz's statement on Taher's trial

A tremendous pressure from some repatriated army officers had forced Ziaur Rahman to try and execute Colonel Abu Taher through a military tribunal in 1976, senior BNP leader Moudud Ahmed told the High Court yesterday (January 20).

Col Taher was a victim of the conflict between the repatriated officials, who did not fight the Liberation War, and freedom fighters in the army, he also said.

Moudud was reading out excerpts from his book -- Democracy and the Challenge of Democracy -- as the court during the hearing on a writ petition asked him to make statement in connection with the trial of Taher.

The High Court yesterday (January 20) directed the government to submit a report on the steps that the government has taken over the torture of and violence against minority people of Shailkupa in Jhenidah district to this court by January 26.

SC probe body: TIB report baseless

HC summons Dhaka DC over Taher case

The High Court Division's bench of Justices AHM Shamsuddin Chowdhury and Sheikh Md Zakir Hossain yesterday directed incumbent Deputy Commissioner (DC) of Dhaka Mohibul Huq to physically appear before it today (Thursday) over the case of Col (Retd) Abu Taher trial.

The bench summoned the Dhaka DC to inform it whether was there any document of the trial, under which Abu Taher was hanged, at the DC office, Deputy Attorney General MK Rahman told journalists.

HC twin-rule against Fire Service DG

The High Court on Monday issued a twin-rule asking the Home Secretary to explain why a directive should not be given for legal steps to be taken against the Bangladesh Fire Service and Civil Defense DG Brig Gen ANM Shahidullah, to investigate alleged corruption in procurement of various modern equipment for the directorate.


The High Court also asked the Establishment Secretary to explain why direction should not be given to rescind its order reappointing Brig Gen Shahidullah for another two years on contract basis.

The rules were made returnable in three weeks, said the court order.

Kamrangirchar OC kept standing before court for 7 hrs

The High Court yesterday kept Officer-in-Charge (OC) of Kamrangirchar police station standing in the courtroom for about five hours for his 'distorted' comment regarding amputation of a child and negligence to court's order.

The International Crimes Tribunal (ICT) on Monday directed the authorities to keep BNP standing committee member Salauddin Quader Chowdhury, MP in custody till April 19, 2011.

Stop promoting illegal housing projects: HC

The High Court on Monday ordered the government to stop the publicity and advertisement of unauthorised housing projects.

A bench of justices A H M Shamsuddin Chowdhury and Sheikh Mohammad Zakir Hossain on Monday asked the government to remove immediately all the installed billboards of such projects and stop their further promotions.

The order came following a petition filed by Bangladesh Environment Lawyers Association (BELA).

During the hearing, Iqbal Kabir argued for the petitioner while deputy attorney general Barrister A B M Altaf Hossain stood for the state.

Writ filed to stop BSF killings at border

A Writ petition was filed on Monday with the High Court seeking its direction upon the government to take effective measures to stop killings of Bangladeshi citizens in the Bangladesh-India border by the Indian force.

A Supreme Court lawyer, Advocate Tazul Islam, filed the petition after a Bangladeshi girl, Felani, was shot to death by BSF and hanged with ware-fancy at Fulbari border while she was crossing the border on January 7.

In the petition, the HC's direction was also sought upon the government to give proper compensation to the family of Felani.

Liberation War Documents: Stay on publishing by Bangla Academy

The High Court on January 16 issued a stay order asking Bangla Academy to refrain from publishing the 15th volume of the Liberation War document.

A bench, comprising justice A H M Shamsuddin Chowdhury and justice Seikh Mohammad Zakir Hossain, passed the order on Sunday following a writ petition by owner of Hakkani Publishers Golam Mostafa.

Ban on JPC committee stayed

The High Court yesterday (Sunday) stayed an order of the lower court that directed the newly elected committee of the Jatiya Press Club (JPC) to return its charges to the outgoing JPC committee.

Following the HC order, there was no legal bar now for the newly elected committee of JPC to discharge its functions, lawyers said.

'Amended law to gear up judiciary'

The government has planned to amend the criminal and civil procedure to infuse dynamism into the judiciary, the law minister has said.

"Trial of any case has to be finished within the shortest possible time to remove the harassment of justice seekers and that will be possible once the criminal and civil procedure is amended," Shafique Ahmed said on Saturday.

Committee is working to find corrupt in Judiciary: CJ

Chief Justice ABM Khairul Haque on Saturday said the committee, formed to investigate into the TIB household survey report, is working to find out the corrupt persons in the judiciary.

The TIB report, published recently, showed the judiciary as top corrupt sector in the country. After publishing the report, the Supreme Court asked TIB to give the report's documents. TIB top officials did so, met with the Judges and clarified different points of the report.

HC declares illegal corporal punishment to school students

The High Court on Thursday declared illegal as well as unconstitutional all kinds of corporal punishment to the students in schools and madrasas enforced by teachers.

Delivering the judgment on a Public Interest Litigation (PIL), the
High Court also asked the government to formulate an effective policy
guideline to bring to an end of all kinds of corporal punishment in
classrooms to ensure a more conducive atmosphere for the students, as
the existing procedure against the perpetrators lacks propriety.

Taher case: HC summons Shawkat, Tribunal judge says he wanted to resign

Mohammad Abdul Ali, one of the judges of the Military Tribunal that tried Col (Retd) Abu Taher and others in 1976, yesterday gave his statement to the High Court bench, saying that he had become a judge as per directive of then Deputy Commissioner of Dhaka AMM Shawkat Ali.

The HC directed AMM Shawkat Ali, former adviser of the last caretaker government, to appear before it on January 18 regarding the Tribunal's trial that sentenced Taher to death in 1976.

3 more judges submit wealth reports to CJ

Three more Supreme Court judges have submitted their wealth statements to the Chief Justice.
The High Court on Wednesday asked the Cabinet Secretary to submit the names and whereabouts of the army men who were pivotal in making decisions from behind to run the state between November 1975 and August 1976.

The court also asked the Establishment and Defense secretaries to submit the names and whereabouts of the members of the Special Martial Law Tribunal which awarded death sentence to Lt Col (retd) MA Taher, Bir Uttam.
Barrister Toby Cadman on January 12 said the principles of the international law and 'due process' must be followed in holding trail of the international crimes in a free and fair manner.

Otherwise, the whole process of such a trial was defected, Toby Cadman, a former prosecutor of Bosnia and Herzegovina, said, "Justice must not only be done: it must be seen to be done."

SC lawyer Iftekha Ahmed for written apology

The High Court on November directed Supreme Court lawyer Iftekha Ahmed for apologising to it in black and while for his false arguments on behalf of Korban Ali, the main accused in a child amputation case.

A bench of the HC comprising Justice AHM Shamsuddin Chowdhury and Justice Sheikh Md Zakir Hossain passed the order.

The High Court has instructed government to reappoint 28 sub inspectors of police who were forced to retire during the tenure of four-party alliance government.

On Monday, a bench of Justice Mohammad Momtazuddin and Justice Govinda Chandra Tagore gave the order following three separate writ petitions as regards the retirements.

Youth correction centre in dismay

Arman is only 12. His bad luck compelled him to land in custody at a juvenile development centre in Jessore over a theft charge at this age.

The shocking incident happened when Arman as a matter of venture left Chittagong for Dhaka by train along with some of his friends and then again they departed for Patuakhali by launch. When they reached Patuakhali, Arman was, somehow, arrested by police over a theft incident.

Police sent him to custody in a correction centre for children named 'Kishore Unnayan Kendra (Juvenile Development Centre)' at Pulerhat in Jessore. The very centre is now the address of Arman for the last few months.

Behavioral correction and mental boom of the children at Kishore Unnayan Kendra at Pulerhat in Jessore are being hampered severely though it has been founded to do so.

The children don't get desired medical facilities, sufficient food and legal support from the kendra (juvenile development centre) which is meant for children's mental correction and physical growth.

Most of the children are suffering from various health problems, including skin diseases, but are not getting medicinal treatment; their clothes are seen dirty; there is no doctor or assistant to attend them at the centre; the post of the doctor is laying vacant for a long.

HC asks govt to remove structures from Cox’s Bazar sea beach

The High Court on Monday ordered the government to remove all temporary and permanent structures from Cox's Bazar sea beach.

Passing the interim order upon a Public Interest Litigation (PIL) writ petition, a High Court division bench, headed by Justice AHM Shamsuddin Chowdhury asked the Deputy Commissioner (DC) and the
Superintendent of Police (SP) of Cox’s Bazar to submit a follow-up report within seven days.

Farida Haque passes away

Farida Haque, wife of Supreme Court's veteran lawyer barrister Rafiqul Haque, has passed away. She was 69.

Farida Haque breathed her last around 4:30am on Friday at the city's BIRDEM Hospital, family sources said.

Secretary Iqbal Mahmud to appear in person before it on January 18,
the latest to face the tune of contempt of court.

Passing the order upon a contempt-of-court petition, an HC division
bench, headed by Justice AHM Shamsuddin Chowdhury, also issued a rule
upon Iqbal Mahmud to explain why contempt proceedings should not be
drawn against him, for deliberately flouting its directive.
