Mayors don't need to resign to participate polls

The High Court yesterday (December 12) stayed effectiveness of the rules of the Election Commission that if the incumbent Mayors wanted to participate in the Pourashava polls, they have to first resign from their posts.

The court also issued a rule to explain that why the rules should not be declared illegal.

A bench of the High Court comprising Justice Md Abdul Wahhab Miah and Justice Md Khashruzzaman passed the order upon a Writ petition.

Following the HC order, the current Mayors can now participate in the coming Pourashava polls, said the petitioner's lawyer.

The EC on December 9 issued a circular that referring Pourashava Rules stated that anybody enjoying a profitable post of the state cannot be candidate in the Pourashava polls.

Challenging it, Thakurgaon Pourashava Chairman Shaheed Kamal Chowdhury filed the Writ petition with the HC.

AM Aminuddin and Munshi Moniruzzaman appeared for the petitioner.
