The High Court on January 16 issued a stay order asking Bangla Academy to refrain from publishing the 15th volume of the Liberation War document.
A bench, comprising justice A H M Shamsuddin Chowdhury and justice Seikh Mohammad Zakir Hossain, passed the order on Sunday following a writ petition by owner of Hakkani Publishers Golam Mostafa.
The court also asked the government to explain within three weeks why Hakkani Publishers should not be directed to publish the documents instead.
In its writ petition, Hakkani Publishers said distorted documents were already published in 2004, which the High Court later declared illegal. Besides, the court also instructed Hakkani Publishers to publish the documents.
"Despite the court order, a number of decisions are being taken to make the court order inactive," said the writ petition. "Following this process, the information ministry on Jan 3 and 4 formed a committee and took a few decisions."
The committee has recommended that Bangla Academy be given the responsibility to publish the documents, the writ petition added.
Advocate Manjil Morshed stood for the plaintiff while deputy attorney general A B M Altaf Hossain appeared for the state.
